Can I get a jury trial for disability benefits under ERISA?

If you file a lawsuit to recover your benefits under ERISA whether it’s ERISA disability benefits or ERISA life insurance benefits you don’t have a right to a jury trial. In fact in most instances you don’t have a right to a trail at all. All the federal court will do is review the administrative record to determine whether or not the plan administrator hired by the insurance company abused their discretion.
