WV Criminal Law Is Pretty Broad
West Virginia law prohibits anyone who is “is a habitual user of narcotic drugs or amphetamine or any derivative thereof” to drive, so you may be in trouble, even if your prescriptions were perfectly legal.
The Penalties Are Fierce
If someone was hurt, or-God forbid-killed in an accident while you were driving under the influence, prosecutors could charge you with a felony. You could be looking at up to 15 years in prison. Even if no one was injured, you could still be convicted of a misdemeanor and have to serve up to six months in jail.
